Transfer of Ownership: Proven Breeder When Breeder, in its sole and absolute discretion, determines that the dog shall no longer be used for breeding purposes, Breeder shall transfer ownership to Guardian at no cost to Guardian. In such circumstances, Guardian must immediately notify Breeder and provide a detailed, written statement of the circumstances that render future performance impossible. If Breeder does take possession of the dog pursuant to this section, Guardian will not be entitled to any compensation from Breeder nor be obligated for any future care of the dog but shall not be absolved or released from any past violations of this Agreement nor damages sustained by Breeder as a result thereof. Neither party may assign, transfer, or subcontract any obligations or rights under this Agreement without the prior written consent of the other party. No changes, modifications or waivers to this Agreement will be effective unless in writing and signed by both parties. In the event that any provision of this Agreement is determined to be illegal or unenforceable, that provision will be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect and enforceable. If Buyer has any concerns, please contact Seller immediately. Pet Insurance. Twenty-four 24 hours prior to picking up the Puppy, Buyer must activate this trial and provide proof of such activation. Insufficient Care. Buyer agrees that it will not surrender the Puppy to a shelter and that it will not sell, give, or release the Puppy to an individual or family, pet shop, retail store, dog dealer, animal testing facility, research facility, or an agent for any such business or facility. Additionally, Buyer agrees that it will not euthanize the Puppy under any circumstances without prior written consent of Seller and instead will return to Seller. If the Puppy is returned within the first thirty 30 days, only half of the Purchase Price will be refunded after the Puppy has been placed in its new home. If the Puppy is returned after the thirty 30 days no money will be refunded to the Buyer. The Buyer pays for all travel expenses back to Seller. Puppy mouthing and biting is a normal stage of puppy development and will not be considered justifiable cause for return of the Puppy. Additionally, temperament behavioral issues will not be considered justifiable cause for return of the Puppy; unless proof of regular obedience training by a certified professional trainer is provided and the Puppy is under four 4 months of age at the time of return. Imperfect puppy bites in pet quality puppies can and do happen. This is typically resolved once puppy baby teeth fall out and adult teeth come in. Condition at Delivery. Seller makes every possible attempt to provide Buyer with a healthy puppy to be a forever companion. Seller tests all breeding dogs in accordance with the highest breed and industry standards. Despite extensive health testing and careful breeding selections, there are medical issues which cannot be tested for and cannot be foreseen. Seller takes reasonable measures to provide Buyer with a happy, healthy, thriving Puppy. Non-Transferability of Health Guarantee. Any transfer or assignment of this Health Guarantee is void. Visits to Veterinarians. The puppy will not be taken to places other dogs frequent, such as pet stores, dog parks, kennels, grooming salons, etc. Companion Purpose; Mandatory Spaying or Neutering. This Puppy is being sold as a companion pet only and is fit for this purpose only, NOT for breeding purposes. If this Puppy is being sold as a breeding dog, a separate contract and price apply. This Agreement will be constructed in accordance with the laws of Texas. If any legal action is to be taken by either Buyer or Seller, the venue shall be in Texas. Adult size, conformation, coat quality, color and pattern of the Puppy are not guaranteed by Seller. It is understood that no warranty or representation has been made regarding this Puppy except as set forth in writing in this Agreement. It is further agreed that the Puppy is of pet quality for the expressed purpose of a companion pet. In the event, the Seller stops breeding, no replacement puppies shall be given, and any obligations of providing a replacement puppy is limited by the supply of available puppies that Seller has on hand at any given time. Annual Vaccinations and Protective Medications. Buyer guarantees that upon receiving the Puppy, Buyer will keep the Puppy in good health with yearly vaccinations, heartworm protection, and any other necessary procedures to ensure the good health of the Puppy. Governing Law and Venue. This Agreement shall be governed by, and construed, enforced and interpreted in accordance with, the substantive laws without regard to its conflicts of laws provisions of the State of Texas. The parties hereto irrevocably submit to the jurisdiction and venue of any state or federal court sitting in Harris County, Texas over any suit, action or proceeding arising out of or relating to this Agreement. Venue shall be mandatory, and not permissive. Payment to be made in full before the puppy leaves the breeder. The Buyer has three days to take the puppy into a veterinarian for an examination. If the puppy is found to be of poor health, Buyer shall immediately provide Breeder with a copy of said report. Buyer may return the Dog to the Breeder and Breeder will replace the Dog. Or, the Buyer has the option of keeping the puppy and the Breeder will reimburse for all documented veterinary costs, up to the purchase price, related to the pre-existing condition. If satisfied with the Veterinarian report, Buyer will retain possession of the Dog and hold Breeder harmless and not liable for any further medical conditions of the Dog. The Breeder provides a warranty for 30 months after the date of sale against any serious genetic disorder that affects the dog's quality of life. Your puppy does not need to be returned to us. All veterinary records must be supplied to the Breeder. In the case of cataracts or PRA the Buyer must provide documentation from a veterinary ophthalmologist. The Breeder reserves the right, at the Breeder's expense, to have the dog checked by a veterinarian of the Breeder's choice before offering a replacement puppy or refund. The Buyer will provide the dog a caring and loving home. The Buyer will take the dog to a veterinarian for an annual check-up and all preventative treatment recommended by the veterinarian will be followed. Our return policy is as follows: For non-emergencies, Buyer agrees to retain Puppy until the Breeder or Buyer can find a new home. This is so that the Puppy only need make one adjustment. All warranties in this contract are non-transferable and become void if ownership of the dog transfers. Please make a copy of this contract for your records and return original. The Seller will reimburse no veterinary or shipping costs. This diagnosis of genetic disease must be provided to the seller in writing with the necessary ancillary documentation. Should the dog be found to have a serious life-altering genetic disease, the seller will provide a replacement from a litter within one year of the claim or refund the purchase price of the puppy. The buyer is required to produce all veterinarian records with the microchip and description of the dog clearly marked, and provide them to the seller. If a puppy replacement option is chosen, the buyer understands that the seller may not have a puppy ready for immediate replacement and may have to wait. The buyer and seller will work together to find a suitable replacement puppy from an upcoming litter. If the Buyer cannot agree to the choices of puppies available within one year of the claim, the warranty is void. This warranty does not cover teeth, dental issues, hernias, allergies, or any sequelae resulting from desexing surgeries. Should the dog be found to be in poor health of a very serious nature, the seller will provide the buyer with a replacement either from the same litter or another litter, or refund the purchase price, not including shipping; however, the seller retains the right to select either option as a remedy. Records must specify the dog clearly by microchip scan and logging of chip number. Veterinarians must certify the accuracy of the records if required by the seller. The parties agree that this contract represents the Full and Final Agreement between the parties and that no other representations, either oral or written have or relied upon for the purposes of this agreement regarding the dog described therein. The parties further agree that no changes in this contract shall be binding upon either of them without written modifications signed by both parties. Both parties agree that the county seat of Riverside County, California shall be the proper jurisdictional venue for this agreement. Upon execution of this contract, all normative veterinary care and its associated costs are the sole and exclusive responsibility of the buyer. The buyer agrees to maintain this dog in good health, provide routine preventative health care, annual check-ups including but not limited to inoculation, internal and external parasites, and preventative medicine. Complete veterinarian records must be provided to the breeder for any request involving a refund or replacement. If any of the above preventative care has not been provided the health warrantee will be void. In the event of the death of the puppy, the buyer agrees to preserve the body until arrangements can be made for an autopsy. In the event of veterinarian recommended euthanasia of the puppy, the buyer agrees to take no action until the seller has approved such action, in any case, the seller again agrees to preserve the body until arrangements can be made for an autopsy. The buyer agrees to provide the seller with a written report with any necessary photographs to substantial any claims of defects. The cost of the autopsy is to be paid by the buyer subject to reimbursement upon determination of cause as a result of a seller's defect. An additional warranty against hereditary orthopedic defects including debilitating hip dysplasia is provided for two years after the date of sale. The guarantee is void should the dog be allowed to become overweight or be involved in any physical trauma that could cause lameness of any type or duration.
