If Breeder does take possession of the dog pursuant to this section, Guardian will not be entitled to any compensation from Breeder nor be obligated for any future care of the dog but shall not be absolved or released from any past violations of this Agreement nor damages sustained by Breeder as a result thereof. Neither party may assign, transfer, or subcontract any obligations or rights under this Agreement without the prior written consent of the other party. No changes, modifications or waivers to this Agreement will be effective unless in writing and signed by both parties. Additionally, Buyer agrees that it will not euthanize the Puppy under any circumstances without prior written consent of Seller and instead will return to Seller. If the Puppy is returned within the first thirty 30 days, only half of the Purchase Price will be refunded after the Puppy has been placed in its new home. If the Puppy is returned after the thirty 30 days no money will be refunded to the Buyer. The Buyer pays for all travel expenses back to Seller. Puppy mouthing and biting is a normal stage of puppy development and will not be considered justifiable cause for return of the Puppy. Additionally, temperament behavioral issues will not be considered justifiable cause for return of the Puppy; unless proof of regular obedience training by a certified professional trainer is provided and the Puppy is under four 4 months of age at the time of return. Governing Law and Venue. This Agreement shall be governed by, and construed, enforced and interpreted in accordance with, the substantive laws without regard to its conflicts of laws provisions of the State of Texas. If satisfied with the Veterinarian report, Buyer will retain possession of the Dog and hold Breeder harmless and not liable for any further medical conditions of the Dog. The buyer is required to produce all veterinarian records with the microchip and description of the dog clearly marked, and provide them to the seller. If a puppy replacement option is chosen, the buyer understands that the seller may not have a puppy ready for immediate replacement and may have to wait. The buyer and seller will work together to find a suitable replacement puppy from an upcoming litter. If the Buyer cannot agree to the choices of puppies available within one year of the claim, the warranty is void. This warranty does not cover teeth, dental issues, hernias, allergies, or any sequelae resulting from desexing surgeries. Should the dog be found to be in poor health of a very serious nature, the seller will provide the buyer with a replacement either from the same litter or another litter, or refund the purchase price, not including shipping; however, the seller retains the right to select either option as a remedy. Records must specify the dog clearly by microchip scan and logging of chip number. Veterinarians must certify the accuracy of the records if required by the seller. The parties agree that this contract represents the Full and Final Agreement between the parties and that no other representations, either oral or written have or relied upon for the purposes of this agreement regarding the dog described therein. The parties further agree that no changes in this contract shall be binding upon either of them without written modifications signed by both parties. Both parties agree that the county seat of Riverside County, California shall be the proper jurisdictional venue for this agreement. Upon execution of this contract, all normative veterinary care and its associated costs are the sole and exclusive responsibility of the buyer. The buyer agrees to maintain this dog in good health, provide routine preventative health care, annual check-ups including but not limited to inoculation, internal and external parasites, and preventative medicine. Complete veterinarian records must be provided to the breeder for any request involving a refund or replacement. If any of the above preventative care has not been provided the health warrantee will be void. In the event of the death of the puppy, the buyer agrees to preserve the body until arrangements can be made for an autopsy. In the event of veterinarian recommended euthanasia of the puppy, the buyer agrees to take no action until the seller has approved such action, in any case, the seller again agrees to preserve the body until arrangements can be made for an autopsy. The buyer agrees to provide the seller with a written report with any necessary photographs to substantial any claims of defects. The cost of the autopsy is to be paid by the buyer subject to reimbursement upon determination of cause as a result of a seller's defect.
